1. Overview
This Refund Policy explains when and how you can get a refund for a kott paid Plan or license. It works together with our Terms of Service and with the refund terms of the payment provider that sold you the Plan. Nothing here removes any non-waivable statutory right you have as a consumer (see Section 3).
2. Merchant of Record — who processes your refund
kott subscriptions and one-time licenses are sold through a Merchant of Record (MoR) — by default Paddle, and Gumroad for certain one-time / Founder licenses (Polar or Stripe may be used where enabled). The MoR is the seller of record: it collects payment, remits sales tax / VAT / GST, and processes refunds and issues the credit. Because of this, a refund is handled under the MoR’s refund terms in addition to this policy, and the credit typically appears on your statement from the MoR rather than from kott. Refunds are issued to the original payment method. [PLACEHOLDER — link the active MoR’s refund terms: [MOR TERMS URL], and reconcile this policy with them before launch.]
3. EU / UK statutory right of withdrawal (digital services)
If you are a consumer in the EU or the UK, you normally have 14 days to withdraw from a distance purchase of digital content or a digital service, without giving a reason. Because kott is delivered digitally and gives you immediate access, the following applies:
Consent to immediate performance & loss of the withdrawal right. When you buy a paid Plan and start using the paid features straight away, you are asked to expressly consent to us beginning the service immediately and to acknowledge that, once the service has been fully performed (or, for digital content supplied on a non-tangible medium, once supply has begun with your consent), you lose your 14-day right of withdrawal to the extent the law provides. If the service has only been partly performed when you withdraw within the 14-day window, you may owe an amount proportionate to what was provided up to that point. Where you have not consented to immediate performance, or the conditions for loss of the right are not met, your full 14-day withdrawal right applies and we will refund you. [PLACEHOLDER — confirm the checkout captures this express consent and acknowledgment; attorney to finalize wording.]
To withdraw within the 14-day window, contact us (Section 7) or use the MoR’s cancellation flow; we will process any refund due without undue delay and within the statutory period.
4. Subscriptions — goodwill refunds & cancellation
Because kott Free lets you evaluate the full engine at no cost before paying, paid subscription periods are generally non-refundable once the period has begun, except (a) where a refund is required by law (including Section 3), or (b) under the goodwill window below, or (c) at our discretion.
Goodwill window. As a courtesy, if you contact us within [GOODWILL REFUND WINDOW] of a charge and you have not made substantial use of the paid features in that period, we will generally arrange a refund of that charge through the MoR. [PLACEHOLDER — set the exact window and any usage conditions; keep consistent with Terms §7.]
Cancellation vs. refund.Cancelling stops future renewals but is not itself a refund of the current period; your paid access continues until the end of the period already paid for. You can cancel any time from your billing portal (Account → Manage billing). See Terms §5.
5. One-time / Founder (lifetime) licenses
A one-time Founder or lifetime license is a single purchase, typically sold through Gumroad as MoR. Its refund window is stated at the point of purchase and handled through the MoR that sold it, together with any applicable statutory withdrawal right under Section 3. Because a lifetime license grants immediate access to the paid feature set, the immediate-performance consent in Section 3 also applies. [PLACEHOLDER — state the exact lifetime-license refund window and any conditions.]
6. Kott for macOS (desktop app) — 14-day refund
Kott for macOS is a $49 one-time lifetime license sold through Paddle as Merchant of Record. For the desktop app we offer a 14-day, no-questions-asked refund: if you request a refund within 14 days of purchase, we will arrange it through Paddle. This is in addition to any statutory withdrawal right under Section 3.
A refund revokes your license key. Because the desktop license is tied to a license key, refunding a purchase revokes that key. Once the key is revoked, its activation stops working and the app will no longer run under that key — so please only request a refund if you intend to stop using the app. The same applies to a chargeback (Section 8). This is described in the Kott for macOS License Agreement.
To request a desktop-app refund, use Paddle’s flow from the receipt it sent you, or contact us (Section 7).
7. How to request a refund
Email [SUPPORT EMAIL] from the address on your Account, with the charge date, amount, and the payment provider shown on your receipt, and tell us why you are requesting a refund. We will coordinate with the Merchant of Record to process any refund due. You can also start a refund or cancellation directly through the MoR using the receipt it sent you. We aim to acknowledge requests promptly and to process approved refunds within the timeframe required by law and the MoR.
8. Chargebacks
If you do not recognize a charge or have a billing problem, please contact us first — we can usually resolve it faster than a bank dispute. Filing a chargeback with your bank instead of contacting us may lead to suspension of the affected Account or license while the dispute is investigated with the Merchant of Record. This does not affect your statutory rights or your right to dispute genuinely unauthorized transactions.
9. Your statutory rights are preserved
Nothing in this policy limits or excludes any non-waivable consumer right you have under the law of your country of residence — including EU/UK withdrawal and conformity rights and the consumer guarantees under the Australian Consumer Law. Where such a right applies, it takes precedence over this policy. See Terms §17.
